On June 18, 2020, the US Supreme Court decided that DHS’s decision to rescind DACA was arbitrary and capricious. On July 17, 2020, the District Court for the District of Maryland order the US Department of Homeland Security to restore the DACA program. However, as of today, the government has not yet formulated a policy with regard to new DACA applications from applicants who qualified as of the day the program began and continue to be qualified. This makes an analysis as to whether to file a new application very complicated. Hence, the DACA dilemma.
